Ex Parte Young Contributed by Stefan Privin

Ex Parte Young allows a federal court to order a State official to stop doing what the court considers a violation of the Constitution or federal law.  Ex Parte Young permits this even where the court agrees that the State is immune under the 11th Amendment.  This year the Supreme Court, in a decision regarding the Telecommunications Act of 1996, allowed the individual members of a State agency to be sued, even though the agency and the State were immune under the 11th Amendment. 

 

The Magic Bullet  by Paul Hanson

In Federalist # 59, Hamilton explains State suffrage as the State legislatures having a voice in the Senate. The 17th amendment effectively cancelled that voice and turned it over to the citizens of the States. James Madison, in Federalist #43, further supports this claim. He states that the Constitution was completely amendable with 2 exceptions only. One was the State’s equal suffrage in the Senate.
